New York’s Licensed Surrogacy Agencies

If you are thinking of starting a family through surrogacy, New York offers some of the strongest protections in the country. New York made history on February 15, 2021, when the Child-Parent Security Act (CPSA) took effect, legalizing gestational surrogacy and making New York the first state in the nation to require licensing for surrogacy organizations.

This groundbreaking law protects both surrogates and intended parents by establishing clear rules and safety standards. Under the CPSA, surrogates must either live in New York State or deliver their baby here, and at least one intended parent must be a U.S. citizen or have been a permanent resident of New York for at least six months.

The New York Department of Health oversees all licensed agencies, ensuring they follow strict screening guidelines from professional organizations like the American Society of Reproductive Medicine (ASRM) and the American College of Obstetricians and Gynecologists (ACOG). All agencies must also comply with the Gestational Surrogates’ Bill of Rights, which guarantees important protections including independent legal representation, health insurance coverage, and the right to make medical decisions during pregnancy.
